For the business relationships between TSR / MedITEX
TSR / MedITEX
and the customer only these terms and conditions are valid. Conflicting or deviating from these Terms and Conditions recognizes TSR / MedITEX not to contradict and hereby expressly. Conflicting terms and conditions are only valid if TSR / MedITEX express written consent.
Orders can be via online shop, e-mail, mail, fax or delivered by telephone. The sales contract is concluded when TSR / MedITEX your order by accepting delivery of the goods.
Prices and shipping costs:
All prices include VAT, packaging and shipping!
All prices are inclusive of VAT, packing and shipping! The payment is in advance. Advance payments made by bank transfer. After ordering you will receive an automated confirmation by email with our bank details and your order assigned order number. This reference number, please enter along with your first / last names as reason for the transfer. Please note that depending on the day and speed of each bank a receipt may take 1 to 5 days. Your order can be processed only after payment has been received.
At your order, you are no longer bound when it is revoked by you within a period of 1 day after receipt. The statement of reasons is not required for the effectiveness of the cancellation. All offers of the company TSR are subject to change. In the case of autogenous unavailability of products we are not obliged to deliver the goods offered. The principle "while supplies last" is valid.
The specific features of our products are available through our descriptions on this website. The mentioned prices are gross prices including the applicable VAT. Shipping costs are generally included in our prices. For delivery abroad shipping costs will be charged. Contract signing and cancellation:
The company TSR undertakes to accept the order of the customer to the conditions shown on this page. The purchaser may in turn by written notice (including by email) revoke the contract within two weeks (see Cancellation and return policy §312 German Civil Code (BGB)). A right or right of return does not apply to goods that have been used by the customer.
Unless otherwise agreed, shipments are delivered from our warehouse to the delivery address specified by the purchaser. The risk passes to the buyer when a delivery from the company TSR or their representatives has been handed over to the consignor.

The purchase price is payable with the order. The buyer can pay the purchase price in advance by bank transfer to our company account, and after receipt of the goods by invoice.
For payment by bank transfer the ordered goods are sent immediately after receipt. The deposit can be confirmed by sending a bank confirmation through fax or e-mail. The delivery of the goods takes place immediately after presentation of this confirmation.
A right to offset the buyer is only granted if his counterclaims have been legally established or accepted by the company TSR.
Retention of title:
Until complete settlement of all claims against the customer the delivered goods remain the property of TSR
We are indicating according to §28 of the Federal Data Protection Act (BDSG) that we collect and retain personal data to execute the order. Personal data will be treated confidentially.
The company TSR expressly undertakes not to pass on the data become known from the buyer to third parties neither paid nor free. In order to inform the customer about news, the details of the customer are stored in a database at the company TSR even after job completion.
The company TSR will give the purchaser full information upon request at any time free of charge about the stored data, as far as it concerns him. On request the customer's data will be deleted immediately. All it takes is a short note from the buyer and / or registered user by phone, fax or email.
Warranties and liability:
If there is a reason for defect of the goods which the company TSR is responsible of, the purchaser can demand repair or replacement delivery. If the company TSR is not capable to remedy the defect or ship a replacement, or if this is delayed beyond a reasonable period for reasons that is responsible for the company TSR or fails in any other way to remedy the defect or fails replacement delivery, the purchaser is entitled to withdraw the contract or to demand a reduction of the purchase price.
Claims for damages of any kind are excluded both against the supplier and against its servants or agents, to the extent permitted by law.
The statutory warranty periods. Faulty goods will be replaced free of charge within 30 days of purchase.
Governing Law and Jurisdiction:
The law of the Federal Republic of Germany stays valid under exclusion of the United Nations Convention on Contracts for the International Sale of Goods. We are entitled to call any other court of competent jurisdiction of the Court instead of the previously agreed jurisdiction.
If any provision of these terms and conditions including these regulations be wholly or partly invalid, or should these Terms and Conditions contain a gap, the validity of the remaining provisions or parts of such provisions stay intact. The provision in question is then to be interpreted as originally intended by their economic and legal objectives are achieved as far as possible. Otherwise, the statutory provisions shall apply.
